Welcome to Transpovia, Inc. (“Transpovia,” “we,” “our,” or “us”). These Terms & Conditions govern your access to and use of our website www.transpovia.com, mobile applications, and related services (collectively, the “Services”).
By using our Services, you agree to these Terms. If you do not agree, please do not use our Services.
1. Definitions
Customer: Any individual or entity booking transportation services via Transpovia.
Provider: Third-party transportation service providers partnered with Transpovia.
Qualifying Service: A transportation service booked through Transpovia that meets commission eligibility.
2. Use of Services
2.1 Eligibility
To use our Services, you must be at least 18 years old and capable of entering into legally binding agreements.
2.2 Account Registration
Customers and Providers may need to create an account.
You are responsible for keeping your login credentials secure.
You agree to provide accurate and up-to-date information.
2.3 Prohibited Activities
You agree not to:
Use the Services for unlawful purposes.
Interfere with or disrupt the platform’s functionality.
Provide false or misleading information.
3. Bookings & Cancellations
3.1 Booking Confirmation
All bookings are subject to Provider availability.
A reservation is only confirmed when you receive a confirmation email.
3.2 Cancellations & Refunds
Cancellation policies vary by Provider. Customers should review the terms before booking.
If a Provider cancels a confirmed booking, Transpovia will attempt to find a replacement.
Refunds, if applicable, will be processed within 7 business days.
4. Pricing & Payments
4.1 Pricing
Prices are displayed in USD and include applicable fees.
Transpovia may adjust pricing at any time before booking confirmation.
4.2 Payment Terms
Customers must pay at the time of booking.
5. Provider Responsibilities
5.1 Service Standards
Providers must fulfill all bookings professionally and on time.
Providers must monitor flights and adjust pick-up times accordingly.
Failure to meet service standards may result in penalties or contract termination.
5.2 No Pick-up & No-Show Policy
Providers failing to fulfill a booking may incur a penalty.
If a customer dispute is upheld, payment may be withheld.
6. Liability & Disclaimers
6.1 Limited Liability
Transpovia is a marketplace platform and does not own or operate any transportation services. We are not responsible for any damages, delays, accidents, or other issues related to services provided by third-party Providers.
6.2 Indemnification
You agree to indemnify and hold harmless Transpovia, its affiliates, and employees from any claims, losses, or damages resulting from your use of the Services.
7. Privacy & Data Protection
Your use of the Services is subject to our Privacy Policy. We only use customer data for service-related purposes and do not sell personal information.
8. Termination
Transpovia may suspend or terminate your account if you:
Violate these Terms.
Engage in fraudulent or unlawful activity.
Fail to provide services as a Provider.
Either party may terminate this agreement with 30 days’ written notice.
9. Dispute Resolution
Disputes will be resolved through binding arbitration in New York, NY, in accordance with the American Arbitration Association rules. The prevailing party is entitled to recover legal fees.
10. Changes to Terms
Transpovia reserves the right to modify these Terms at any time. Continued use of the Services after changes constitutes acceptance of the updated Terms.
